These Terms of Service ("Terms") govern the services provided by Same Day Web Pages, operated by Merica Motor Merch Co., LLC ("we," "us," or "our"). By purchasing or using our services, you ("you" or "the customer") agree to these Terms.
We design and build a clean, static website for your business for a one-time fee. The standard price is $650. Promotional pricing (for example, an introductory rate) applies only where and when we expressly offer it. Optional ongoing hosting and maintenance is available for $25/month.
The build fee is due as presented at the time of purchase, processed securely through Stripe. The price you are quoted or shown at checkout is the price that applies to your order. Optional hosting, if selected, is billed monthly and may be cancelled at any time.
Any demo or preview website we create remains the sole property of Same Day Web Pages until your build fee is paid in full. You may not copy, host, publish, or use a demo site (or its design and code) until payment is complete.
Once your build fee is paid in full, you own the website files and the content you provided. As part of your build, we will register one standard domain name on your behalf and you will be the owner of that domain. Premium or higher-cost domains are available at an additional cost, quoted to you before purchase.
Your build covers the design and creation of your static website as agreed. Unless expressly stated, the following are not included:
We want you happy with your site. Reasonable revisions to the agreed scope are included around delivery. Work beyond the agreed scope is billed at $50/hour, quoted to you before we begin.
Because you review and approve your finished website before payment is collected, sales are final once payment is made and your site files are delivered. If you have a concern, contact us and we will work in good faith to make it right.
You agree to provide accurate information and confirm that you have the right to use any content, logos, photos, or text you give us for your site. You are responsible for your own domain, third-party accounts, and the lawful operation of your business.
Your site may use third-party services (for example, Stripe for payments, a form provider, or a scheduling tool such as Calendly). Those services are governed by their own terms, and we are not responsible for their availability or performance.
Our services and any delivered website are provided "as is" and "as available" to the extent permitted by law. We do not guarantee specific business results, traffic, or revenue.
To the maximum extent permitted by law, our total liability for any claim relating to our services will not exceed the amount you paid us for the build. We are not liable for indirect, incidental, or consequential damages.
You agree to indemnify and hold us harmless from claims arising out of content you provide or your use of the website we build for you.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. The "Effective date" above shows when they were last changed. Your continued use of our services means you accept the updated Terms.
